Privacy of Circulation Records

The board of library trustees of the Aberdeen District believes that efforts to gain access to library circulation records constitutes an invasion of the right of privacy of the library patrons, and that if permitted would do damage to the education and social value of the libraries of this country.

These records are considered to be confidential in nature, and shall not be made available to any individual, or to any agency of state, federal or local government except pursuant to such process, order or subpoena as may be authorized under the authority of, and pursuant to federal, state, or local law relating to civil, criminal or administrative discovery procedures of legislative investigatory power. Code # IC9-340

Patriot Act Policy

Staff receiving requests or subpoenas for information:

    Contact:

1st – Director

    2nd – Chairman of Board

3rd – Business Manager: If pertaining to financial records

Have legal counsel review requests or subpoenas. Specifically if it involves financial matters.

One board member should be present to witness any proceedings (searches) from requests.

USA Patriot Act supersedes State confidentiality laws. This means the less personally identifiable information we have the less we would have to turn over.
